If the crime is one involving moral turpitude (MT hereafter) then the IJ has no discretion and the alien must be tossed out of the country. Many cases before the Board of Immigration Appeals (BIA), an arm of the Justice Department, revolve around these and related questions.

Excerpt: The goal of the campaign — the high point of which was the Southern Poverty Law Center's bogus designation of one of the national restrictionist organizations as a 'hate group' — was to drive all immigration skeptics out of the public debate by labeling any skepticism about immigration as inherently racist. In other words, to make questioning mass immigration the same as questioning the desegregation of lunch counters. The smear campaign was developed at a series of meetings after the defeat of the 2007 amnesty out of despair at having failed so completely despite their holding the commanding heights of society and economy and politics. While I'm sure some of the principals saw it as a cynical move, I think many of the open-borders folks (including those on the right) were sincere because they are literally unable to conceive of any reason other than hate for favoring less immigration and tighter enforcement. It's not just that they think Jeff Sessio! ns and Lamar Smith and Roy Beck and I are racists, but that there's no way we could be anything but racists.

Montana Adopts Legal-Presence Requirement of REAL ID Act

Excerpt: Montana has just passed a law requiring both legal presence for driver's license applicants and expiration of a driver's license on the same day that the holder's federally mandated legal presence expires (in the case of nonimmigrants). Oddly, this is the same REAL ID secure driver license law that Montana's Gov. Brian Schweitzer described in March 2008 on NPR as a 'harebrained scheme' for 'kookie IDs that do not make us more secure.' Back then, Schweitzer touted that his legislature voted 150 to 0 to not implement REAL ID. On April 18, 2011, three years later, he partially swallowed his words (although he had not a word to say) by signing a law that directly supports the legal presence aspects of REAL ID. The law had passed the House and Senate by more than two-to-one.

Mormons And Immigration
WASHINGTON (April 20, 2011) – In the wake of Utah's passage of a guestworker/amnesty bill, the role of the Church of Jesus Christ of Latter-day Saints in that effort, and the stance of the Church on immigration issues generally, has come under scrutiny. While nominally neutral on the issue, the Church seems to have moved toward support for illegal immigrants and opposition to immigration enforcement. Contradictions between official Church policies, the statements of senior Church leaders, and the actions of the Church’s public affairs and media groups have sparked considerable debate among members.
A new paper from the Center for Immigration Studies is the first look at this issue. “The Mormon Church and Illegal Immigration” is authored by Ronald W. Mortensen, PhD, a Fellow at the Center for Immigration Studies, retired career U.S. Foreign Service Officer, and member of the LDS Church. Among the findings:
- The Church still teaches that 'Members should obey, honor, and sustain the laws in any country where they reside or travel.' In spite of this, the Church baptizes and extends full membership to illegal aliens who are not obeying, honoring, and sustaining the laws of the United States where they now reside.
- The Church calls for compassion for illegal aliens who are committing serious violations of U.S. immigration and criminal laws, but ignores justice for an estimated 50,000 Utah children and over one million Arizona children and their families, who are the victims of job-related identity theft.
- At the same time the Church tells new converts in the poorest countries and villages in the world to stay where they are in order to build up the Church there, its public affairs and media groups and surrogates accuse those who ask people illegally in the United States to return to those very same countries and villages of being mean-spirited and cruel.

The Washington Post reports that a pair of Korean immigrant women is headed to prison for trafficking in illegal South Korean females. The illegal aliens worked at the jail-bound madames' bar, which profited the madames several million dollars. According to the Post, the 'hostesses' served, drank with, flirted, sang, and danced with customers, who were required to buy an expensive bottle of liquor. The women 'dress[ed] provocatively.'

Excerpt: In the same area where I filmed 'Hidden Cameras on the Arizona Border 3: Guns, Drugs, and 750 Illegal Aliens', one likely drug runner was shot and another killed yesterday evening in a shoot out between drug smugglers. The exact area of the shooting, Antelope Peak, was about a mile from the first segment of that film which highlights the travel methods of drug cartels. I had recently posted new footage and analysis of the issue after hearing that drug smuggling activity from across the border had picked up again in this area known as Vekol Valley. The surge of such activity came after months of quiet caused by significant attention to the area driven by sources as diverse as my Hidden Cameras film, Pinal County Sheriff Paul Babeu's pronounced immigration law enforcement effort, and Arizona Gov. Jan Brewer's immigration laws.

House Hearing Lays Down Record for Ending the Visa Lottery

Excerpt: On April 5, 2011, I testified before the House Judiciary Subcommittee on Immigration Policy and Enforcement on a bill that would eliminate the Diversity Visa lottery (DV) program. The hearing was specifically on H.R.704, the SAFE for America Act, is sponsored by Rep. Goodlatte (R-VA), who has been seeking to do away with the visa lottery for years. This was the first time Goodlatte has received a legislative hearing on this bill.
The lottery provides 50,000 visas every year to those from more than 170 nations who send relatively few immigrants to the United States, including state sponsors of terror and nations with known radicalized, anti-U.S. populations. Organized crime also takes advantage of the program in a multitude of ways. In addition, the program is riddled with fraud, and none of the problems outlined by CIS Executive Director Mark Krikorian in his 2005 Congressional testimony on the subject have been reduced sufficiently to justify maintaining the program.

In 2006 the state enacted Romneycare, which many consider to be the precursor to Obamacare. A recent report from the Massachusetts Inspector General has found that state agencies have failed to implement controls to prevent ineligible people – including illegal immigrants – from getting free taxpayer-funded health care.
The audit found that the Commonwealth has provided millions of dollars worth of free health services to residents of foreign countries, as well as residents of other states, who should not have qualified in the 'free care pool,' which is supposed to be only for legal residents of Massachusetts who do not have health insurance.
