Where are the H-1B Geniuses?
By John Miano
CIS Blog, May 8, 2011
http://cis.org/miano/where-are-the-h1b-geniuses
Excerpt: The U.S. imports about 100,000 people a year on H-1B visas. The public is constantly told that this mass of labor imports represent the 'Best and Brightest' in the world.
Where are the big accomplishments from those on H-1B visas?

Obama's Rule of Lawlessness
By James R. Edwards Jr.
CIS Blog, May 8, 2011
http://cis.org/edwards/holder-decision-same-sex-marriage
Excerpt: The Obama administration seems married to an ideology of willful lawlessness. Attorney General Eric Holder has vacated a ruling of the Board of Immigration Appeals concerning a deportable alien on account of sexual orientation. The next day, a similar deportation was held up on the same grounds.

Holder Sends Signal Supporting Marriages of Gay Immigrants
By David North
CIS Blog, May 8, 2011
http://cis.org/north/holder-decision-same-sex-marriage
Excerpt: Attorney General Eric Holder sent a signal earlier this week, opening the possibility that the Justice Department might view marriages involving gay migrants as comparable to traditional (i.e., one man-one woman) marriages.

Just Another Mafia
By James R. Edwards Jr.
CIS Blog, May 7, 2011
http://cis.org/edwards/just-another-mafia
Excerpt: The Washington Post ran a front-page story Saturday about a Mexican ID forgery ring that had operated in eleven states, from Rhode Island to North Carolina to Arkansas. This news item makes clear that the Mexican mobsters in charge of this illicit business amount to nothing more than a bunch of foreigners willing to break the law to make big bucks – and nothing less than a bunch of hardened criminals whose business opportunity relied solely on the failure of American officials to get serious about immigration.

An Intriguing (but Probably Flawed) Idea - the Sacrifice Bunt Visa
By David North
CIS Blog, May 6, 2011
http://cis.org/north/sacrifice-bunt-visa
Excerpt: I am not at all sure it is a good idea, but it certainly is an intriguing one.
The reference is to the proposed 'Sacrifice Bunt Visa.' An illegal alien in the U.S. would agree to leave the nation, and in return, he or she would nominate one other illegal alien to be legalized. Thus at a single stroke, the total population of the country would shrink by one, and the population of the illegals in the country would drop by two.

Illinois Governor Moves to Protect Illegal Alien Criminals
By Jessica Vaughan
CIS Blog, May 6, 2011
http://cis.org/vaughan/Illinois-backs-out-of-secure-communities
Excerpt: Illinois Gov. Pat Quinn has announced his intention to cancel the state's agreement with ICE to allow law enforcement agencies in his state to share arrest information with ICE under the Secure Communities Program, saying he was 'not satisfied' with the results. Quinn expressed concern that ICE has removed a large number of illegal aliens who committed minor crimes in addition to dozens of criminal aliens with convictions for serious felonies.
Let's take a look at those Secure Communities results in Illinois. Twenty-six counties have been using the program since it started there in November 2009. Cook County, which is the largest in Illinois and one of the largest in the country, has refused to participate, declaring itself a sanctuary for illegal aliens. Cook County jail officers routinely release illegal alien offenders, even if ICE has asked for custody. Their policy is, 'We do not work with immigration.' (See this posting of mine from last year.)

Republicans and Immigration
By Mark Krikorian
CIS Blog, May 5, 2011
http://cis.org/krikorian/republicans-immigration-hawley
Excerpt: The standard line among the high-immigration right (earnestly, if insincerely, seconded by their fellow-travelers on the left) is that Republican opposition to open immigration is driving otherwise-conservative immigrant (and/or Hispanic) voters into the arms of the Democratic Party. Some new research suggests it's actually the other way around. Far from Republican anti-immigration views pushing immigrants further toward the Democrats, it's immigrant anti-Republican views that pushes Republicans further toward restriction.

USCIS Spends Too Much Time on Tiny Populations, Including Dead Ones
By David North
CIS Blog, May 3, 2011
http://cis.org/north/form-revision-tiny-populations
Excerpt: USCIS, thanks to its own inclinations and congressional thoughtlessness, spends too much executive time on tiny populations, including dead ones.
Recently that agency's busy Office of Public Engagement, unwittingly exposed this tiny- population focus when it, usefully, reminded all and sundry of some form revision notices in the Federal Register.

Dark Secrets Of The Opposite Sex
A caller to Dennis Prager’s radio show today, Michael, says: “Even though a wife will swear and claim she won’t do it, a wife will put the below adulthood children’s welfare above yours. Even though they may rationally know that is not a good idea, they can’t control themselves.”
Dennis seems to think it is the female inclination to put her children before her husband and she should fight that urge. The marriage should come first.
Dennis: “The instinct is universal. The culture today reinforces the instinct. It is a culture of helicopter parents, parents constantly hovering over the child.
“I grew up in a home where the parents put each other first.”
How Did I Get In This Position?
All the air went out of my tires tonight when I realized…
This happens to me over and over again. I have to believe I have a backstop so that I can go out and do what I want.
Then eventually I find out that no backstop is forever and this forces me to grow up a little bit.
One of my backstops over the past 14 years has been my guest house. Now this is gone. I have to move into the world and make my way.
I felt so deflated when I got the news Tuesday evening that I’d need to move out in June. I was just down for the count. I wanted to cry.
I Don't Like To Look At Fat People
Unless the person has some extraordinary qualities or proximities to me, I don’t like to look at fat people.
If I see the person in shul or at work or in a writer’s group or at yoga and I get to know them, then I forget about them being fat and I relate to them like they’re human, but otherwise, I tend to shy away from fat people. I’m judgmental. I think fat people should lose weight and until they do, they’re just too sloppy for me.

Parashat Emor (Leviticus 21:1-24:23) X
This week’s we study Parashat Emor (Leviticus 21:1-24:23).
* I suspect the Torah would rejoice in the royal wedding. Here are two goys pledging eternal fidelity. The Torah is cool with people having a special role, including kingship, by birth. Psalm 45 is about the joy of a royal wedding.
* Is it sacrilegious or sinful to say that some Torah portions are more or less riveting than others? For instance, the traditional commentators such as Rashi and the Rambam had more to say and less to say about varying parshas.

Backgrounder On Tom Cruise - Scientology - Simon Weisenthal Center
The Simon Wiesenthal Center (SWC) has decided to honor Tom Cruise with its humanitarian award at a fundraising dinner of Hollywood celebrities and power brokers on May 5 in Los Angeles. California Senator Diane Feinstein and producer Steven Spielberg are among the co-chairs.
The news has been greeted with shock and dismay by former Scientologists and activist advocates for victims of Scientology abuse since Tom Cruise is known to millions as the chief celebrity promoter of Scientology, and there are numerous testimonies of violence and abuse within the Church of Scientology.
SWC was founded in 1977 by Rabbi Marvin Hier as a Jewish human rights organization and named after Nazi-hunter Simon Wiesenthal. It promotes human rights, combats anti-Semitism, and teaches lessons from the Holocaust. The organization operates on a budget of $28 million and is headquartered in Los Angeles. It maintains Museums of Tolerance in Los Angeles, New York, and Jerusalem, and offices in Toronto, Paris, and Buenos Aires.
There has been a flood of reporting on Scientology abuses in the last two years the most recent of which is Lawrence Wright’s massive article on the defection of Oscar-winning director Paul Haggis. The St. Petersburg Times has exposed violence and abuse in Scientology leader David Miscavige’s regime in its The Truth Rundown series. In light of these reports SWC’s decision seems inexplicable.
There has been no commentary in the main stream media on the humanitarian award to Cruise, but Danielle Berrin at the Jewish Journal’s Hollywood Jew has given us the first report. She addresses the questions about why Cruise should qualify as a humanitarian. She quotes SWC founder Rabbi Marvin Hier, and two Board members, one of whom drops the F-bomb.
A second important commentary comes from William Burke at Ask the Scientologist. He is a former Scientologist and one of the sharpest analyzers of Scientology currently writing.
Burke takes no issue with SWC’s decision but focuses on how the Church of Scientology will exploit the award to legitimize itself and point to SWC as an approver of its status as a legitimate religious and humanitarian organization. Burke also explicates core Scientology doctrine that blames victims of the Holocaust for their fate and places the SWC event in the context of Cruise’s career rehabilitation.
SWC founder Rabbi Hier in saying that SWC respects all faiths elevates L. Ron Hubbard to the status of Moses and places Scientology at par with Judaism, Christianity, and the other great faith traditions that have shaped lives and civilizations for millennia.
Scientology, which began in 1950 with Hubbard’s publication of Dianetics, is recognized as a religion in only a handful of nations. It has no recognition as a religious organization in Israel, where it is widely considered a business enterprise and a cult.
Though Scientology is recognized as a religion by the IRS, no US citizen is bound to deal with Scientology on that basis except in the strictest of legal circumstances. Millions of Americans are adamant in their belief that Scientology is in essence a business and in no way a legitimate religious let alone a human rights organization.
Noted Holocaust scholar Professor Deborah Lipstadt at Emory University in writing about Tom Cruise has put her finger on the problem when she quotes a major critic of Scientology, Ursula Caberta of the Government of Hamburg’s Scientology Working Group, about Cruise being the celebrity promoter of a totalitarian regime.
Not many familiar about Scientology abuses are likely to be convinced by Rabbi Hier’s contention that it is possible to honor Cruise the humanitarian while not honoring Cruise the Scientology promoter.
Scientology itself will not be in agreement with Rabbi Hier because it will gleefully exploit SWC’s humanitarian award as legitimizing the cult. In its propaganda it trumpets: “Tom Cruise has disseminated LRH technology to 1.1 billion people of earth.” A Church of Scientology video interview “Tom Cruise and Tom Cruise, Scientologist” was leaked to the internet in January 2008. It has been viewed over 6.5 million times.
The Church of Scientology forced YouTube to remove the video and in so doing sparked the largest opposition the cult has seen in its sixty-year history. Outraged at this suppression of free speech on “their internet” thousands of college students around the world formed the Anonymous anti-Scientology movement and have been relentlessly protesting on the streets and the internet for the last three years. Their impact has been enormous in liberating people terrified of speaking out for fear of Scientology’s intelligence agency, the Office of Special Affairs (OSA).
There are other important Jewish dimensions. Foremost is the totalitarian cult’s 15-year-long persecution of Holocaust survivor Paulette Cooper. Shortly after her birth her family was sent to a concentration camp. Her parents were subsequently murdered in Auschwitz. Seventeen of twenty-two of her relatives died in the Holocaust.
Raised in a kosher home after being adopted by US parents, she graduated from Brandeis University. In accord with the best Jewish values of sympathy for the underdog and a passion for justice she wrote one of the first critical books about the cult, The Scandal of Scientology. Scientology conceived Operation Freak Out to silence her. It used covert agents to smear her with accusations of engaging in sexual perversions with her rabbi.
They stole stationery with her fingerprints and wrote bomb threats for which she was indicted and arrested. She faced a nightmare proving her innocence and was sued nineteen times by the cult. When the cult’s intelligence agency was plotting to smear her before she came to testify at hearings in Clearwater, FL, (Scientology’s self-proclaimed Mecca) one official wrote in a telex:
Paulette’s reflection on her experience is here. An interview with Jewcy.com is here.
Why is a Jewish human rights organization honoring Cruise when Scientology’s human rights abuses will be hanging over the event?
Profesor Lipstadt has addressed two important issues: the cult’s shameless exploitation of the Holocaust against psychiatry and its campaign against the German government comparing Scientologists to Jews and the German government to Nazis.
She has called Scientology’s blaming psychiatrists for the Holocaust a “soft-core” form of Holocaust denial since it does not place blame where it truly belongs, on the shoulders of the Nazi regime.
Scientology’s campaign against the German government sent Rabbi Ignatz Bubis into a rage and dismayed Abraham Foxman at the Anti-Defmation League. Bubis was chairman (and later president) of the Zentralrat der Juden in Deutschland (Central Council of Jews in Germany)
Scientology is engaged in a War on Psychiatry that aims at nothing less than the destruction of all mental heath professions and institutions, in which Jews have played a pioneering role from Freud through Otto Selz, murdered at Auschwitz, and Viktor Frankel, who survived, and many others.
Scientology may rightfully be considered a hate group and has been so named by American Psychiatric Association President, Dr. Nada Stotland:
Also relevant is the fact of opposition to Scientology in Israel. Benjamin Beit Hallahmi at Haifa University has written extensively on New Religious Movements and denies Scientology’s status as a religion.
Scientology in Israel is not considered a religion but rather a cult, and there has been an important investigative report from Friday Studio on Israeli TV (Part One; Part Two). There is also an organization called The Israeli Center for Victims of Cults. Their Scientology page is here.
Though Christian leaders have scarcely spoken out any more than Jewish leaders, Roman Catholic Cardinal Ouellet of Quebec has warned Catholics and criticized Scientology at his last two annual press lunches The Catholic Archbishop of St. Lucia has denounced invasion of the island by the Scientology front group, The Way To Happiness International.
Scientology in Itay has threatened to sue a women’s religious order, the Daughters of St. Paul, for publishing books by a former Scientologist who has returned to practice of her Catholic faith. Jesuit sociologist Fr. John Coleman has described Scientology as a “totalitarian cult.” Editor Randy Sly at Catholic Online has written extensively and been lambasted by Scientology spokesman Tommy Davis for promoting “religious hatred and violence.”
The best interpretation one can put on SWC’s decision is that it was made in naive ignorance. There is no indication that SWC has revisited its decision and so the event is most likely to proceed as planned. It will not be the first time that Mammon has triumphed over Moses in Hollywood.
As scandalous as the Wiesenthal-Cruise affair appears to many, one can hope that it will be the occasion for discussion of Scientology particularly within the Jewish community. Totalitarian regimes cannot abide the truth; they start to crumble when people speak out.

Immigration Reform
WASHINGTON (May 2, 2011) – Next week, on May 12, the State Department will host a public meeting on the appropriate size and scope of the U.S. Refugee Admissions Program (USRAP) for next year. This is an opportune time, then, to take a hard look at problems besetting this component of our immigration system.
To that end, the Center for Immigration Studies has published “Refugee Resettlement: A System Badly in Need of Review,” authored by CIS Fellow Don Barnett. He finds that our refugee resettlement system has failed refugees, both by diverting limited resources from overseas assistance and by the sheer neglect of those resettled in the United States by their “sponsors.” In addition, the program is rife with fraud, profitable for hundreds of “non-profit” organizations, and is a potential channel for terrorism into American communities.
The report is online at http://cis.org/refugee-system-needs-review. Among its findings:
- Security Matters. Meaningful background checks are difficult to obtain for refugees admitted from countries without reliable government records.
- U.S. Taxpayers Without Borders. The U.S. welfare system is a global magnet, which has been instrumentalized by the international refugee industry.
- Exploitation for Profit. Refugee resettlement is very profitable for some non-profits, who consistently refuse to commit any of their own resources for the resettlement effort.
- American Community Impact. Some American towns have been overwhelmed by the arrival of refugees. At no point are these communities consulted.
- Non-Assimilation. The USRAP is increasingly bringing in groups that have stated openly they do not intend to assimilate into American culture.
- Chain Immigration. The initial admission leads to exploitation of the chain immigration system.
- Abandonment upon Arrival. Despite PR about supporting refugees, NGOs routinely abandon their charges after four months or less, moving on to the next, more profitable, cycle of recent admissions.
- Globalized Disease. Refugees and those arriving on various “following-to-join” programs are bringing in HIV, hepatitis, TB, malaria, and other diseases.

Refugee Resettlement
A System Badly in Need of Review
By Don Barnett
CIS Backgrounder, May 2011
http://www.cis.org/refugee-system-needs-review
Excerpt: One has to be careful when trying to explain the U.S. Refugee Admissions Program (USRAP). Too much truth and in too much detail leaves those unfamiliar with the program looking at you like you are crazy. Among those unfamiliar with the topic — and therefore unable to completely process and act on information about it — are most of the political elite, especially Congress.

Public Comment on DHS Docket No. USCIS-2008-0014 (Proposed H-1B Regulations)
By David North
CIS Testimony, April 2011
http://www.cis.org/node/2765
Excerpt: This is a proposed 'streamlining' of an aspect of this foreign worker program, H-1B, that would come into play after the Congressionally-mandated ceilings of 65,000 and 20,000 new visas are exhausted under this program. It would allow would-be employers to place in priority order the foreign workers they wanted though this program if their applications were among those that reached and exceeded the ceilings. In former years a lottery had been conducted among the names of the wanted workers, which gave the employers some of the workers they wanted, but not in the order that they wanted them. No employer was ever saddled with a foreign worker the employer did NOT want.

Does Parroting Lobbyists Constitute 'News analysis'?
By John Miano
CIS Blog, May 2, 2011
http://www.cis.org/miano/cokie-roberts-news-analysis
Excerpt: This week provided a wonderful example of why public funding for NPR should be cut off.
In the tech industry it has become routine for Americans to be replaced by lower-paid foreign workers on H-1B visas. The repeating pattern is for the U.S. employer to contract with an H-1B bodyshop to supply labor to replace its American workers. The U.S. employer then requires its American workers train their foreign replacements.

USCIS Overturns 'Early Bird Gets the Worm' Rule in H-1B Program
By David North
CIS Blog, April 29, 2011
http://www.cis.org/north/USCIS-overturns-early-bird-rule
Excerpt: Throughout our lives we are told that 'that the early bird gets the worm,' that it is a good idea to be 'early to bed and early to rise,' and that a 'stitch in time saves nine,' but USCIS has now overruled those mottos in the H-1B program.
It now is about to impose a set of rules in that foreign high-tech worker program to, in effect, make life easier for the late birds, the late risers, and the non-stitchers among the greedy employers who use the H-1B program to lower their labor costs, and deny jobs to American workers.

State Department Regs Guarantee Loss of 120,000 American Jobs
By David North

Excerpt: I suppose it is progress when one of the State Department's alien worker programs decides that foreign college students can no longer be used as rickshaw operators, or in their words: 'as pedicab or rolling chair drivers'.
It certainly is a refreshing bit of transparency when the department admits that its Summer Work Travel program had sometimes been used to staff 'money laundering, money mule schemes and Medicare fraud', though no details are provided.

There has been some real progress, most notably in Georgia, but not as much as you would have thought from the hype. Some of that is because it was hype, and most bills in any legislature never get anywhere.

But in the world of Spanish-language corridos, the ballads that give voice to the experience of illegal immigrants, Superman's citizenship has long been in doubt. That is mostly due to the group known as 'Los Hermanos Ortiz,' the Ortiz Brothers, in the catchy and clever 'Superman Es Ilegal'.

Utah's Actions Analyzed at Immigration Policy Conference
By David North
CIS Blog, April 27, 2011
http://www.cis.org/north/utahs-actions-anaylzed
Excerpt: While all the talk was, subtly, in favor of mass immigration, there were some conflicting views regarding the recent Utah developments at the 8th Annual Immigration Law and Policy Conference in Washington on April 26.
The event, at the Georgetown University Law School, was co-sponsored by the Migration Policy Institute (MPI) and the Catholic Legal Immigration Network. It is a continuation of a series of such events that, with somewhat different sponsorships but with an identical policy orientation, have been happening every spring since at least 1969.

Excerpt: In yesterday's blog, I noted that New York Times reporter Jason DeParle had responded to questions I had emailed him regarding his April 17 front-page story. I did not quote from the response because I had offered to embargo it for a year. I offered the embargo because I thought he might be more comfortable and candid if he knew that the answers would be printed long after the initial controversy of his story had cooled. I hope to write at length about the story and about the Times' immigration coverage and commentary. But not today and not for awhile.
Last night DeParle sent me an email, giving me the okay to lift the embargo. Below is his response, as I received it. The only change I have made to the substance is the deletion of the name of the Times editor he mentions in the second paragraph. The editor, an acquaintance for whom I have tremendous respect, did not edit DeParle's story. DeParle refers here to the CAP and the SPLC; they are the Center for American Progress and the Southern Poverty Law Center.

Bahamas Gets It Right on Investment Levels and Streamlining
By David North
CIS Blog, April 26, 2011
http://www.cis.org/north/bahamas-investor-visas
Excerpt: Sometimes it is downright embarrassing to find tiny Third World nations handling immigration challenges better than the mighty U.S. does.
For example, The Bahamas has just decided to triple the investment needed if you want to get permanent residence there; the bar used to be $500,000 (often used to buy a house) and now it is $1,500,000. These are Bahamas dollars, but they are worth, depending on the mood of the market, a hair more or a hair less than the U.S. dollar.

Is it Time for a National Latino Museum?
By Dominique Peridans
CIS Blog, April 25, 2011
http://www.cis.org/peridans/national-latino-museum
Excerpt: The New York Times recently published an article by Kate Taylor, on a proposed national museum intended to honor 'Hispanic' Americans: 'National Latino Museum Plan Faces Fight' (for our purposes, 'Hispanic' and 'Latino' will be used interchangeably). I would venture to say, from the outset, that the 'fight' cannot simply be another disturbing example of sportive activity by entrenched naysayers of the majority who have found another worthwhile project to deny those whose different ethnicity makes them feel uncomfortable. Real questions do arise. What exactly would such a museum mean? What exactly would such a museum represent? Whom exactly would such a museum represent?

A Message from Jason DeParle, and a Response
By Jerry Kammer
CIS Blog, April 25, 2011
http://www.cis.org/kammer/message-from-deparle-and-response
Excerpt: In Friday's blog post, which responded critically to the previous Sunday's lengthy New York Times article about John Tanton, I noted that on April 17, DeParle had responded to an email from me in which I had questioned the story. As I noted in the blog, while DeParle's email said he would send me a note the next day, I had not heard from him.
About six hours after I submitted that blog, I received an email from DeParle. It was a thoughtful response that I want to acknowledge here. But since I had pledged to embargo his comments for one year if he preferred, I will not quote from it here. If I write an analysis of immigration journalism, as I hope eventually to do, I expect I will quote him there at some length. That will not happen for at least a year.
Albert Haynesworth Swipes Credit Card In Cleavage
Luke Ford writes: Women are constantly throwing themselves at me. Luckily, I have a God-given universal moral code to live up to and that prohibits me from swiping my credit cards in waitresses’ cleavage.
Lara Logan: They Raped Me With Their Hands
Luke Ford writes: In February, CBS, after learning that other media were asking questions about the incident, said that its correspondent Lara Logan “suffered a brutal and sustained sexual assault and beating” in Cairo’s Tahrir Square. Lara Logan thought she was going to die in Tahrir Square when she was sexually assaulted by a mob on the night that Hosni Mubarak’s government fell in Cairo. Ms. Logan, a CBS News correspondent, was in the square preparing a report for “60 Minutes” on Feb. 11 when the celebratory mood suddenly turned threatening. She was ripped away from her producer and bodyguard by a group of men who tore at her clothes and groped and beat her body. “For an extended period of time, they raped me with their hands,” Ms. Logan said in an interview with The New York Times. She estimated that the attack lasted for about 40 minutes and involved 200 to 300 men.

Muslim Actress Poses Nude For Playboy
Luke Ford writes: When a Jew or a Christian poses naked or engages in intimate relations on video, her co-religionists don’t threaten to kill her for her sins. Sure, those who take their religion seriously are disgusted by her behavior, nobody gets more riled up about women running around naked than myself, not even Osama Bin Laden, but it wouldn’t even occur to me to threaten to kill her. I’d rather love her and gently instruct her that the queen’s power lies within. Heck, some of us would even be willing to marry her (provided she converted to Orthodox Judaism), if only to make an honest woman of her and to save her family from shame. I wonder if she has high self-esteem?
